mindo Terms of Service

These Terms of Service ("Terms") govern your access to and use of mindo, a service operated by DATAO Ltd. Company ("DATAO," "mindo," "we," "us"). By creating an account, accessing, or using mindo, you agree to these Terms.

  1. Who May Use mindo

You must be at least 18 years old to create an account or use mindo. By creating an account or using mindo, you represent that you are at least 18 years old.

You may not use mindo if applicable law prohibits you from receiving or using the service.

You must provide accurate information when creating your account and keep your account credentials secure. You are responsible for activity conducted through your account unless applicable law provides otherwise.

  1. The mindo Service

mindo is designed to support reflection, expression, discovery, meaningful interaction, conversation, and connection. Features may include private reflection, posts, profiles, resonance, comments or responses, Connect, Dialogue, Resonance Rooms, search, discovery, collaboration tools, location-related discovery, and other experiences.

We may add, remove, modify, test, limit, or discontinue features over time.

mindo does not guarantee that any particular content, person, recommendation, connection, conversation, opportunity, or outcome will be available or suitable for you.

  1. Your Content

You retain ownership of content you create and submit to mindo, subject to any rights held by others in material you include.

By posting or otherwise making content available through mindo, you grant DATAO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt as technically necessary, display, distribute, and otherwise use that content as necessary to operate, provide, maintain, secure, and improve mindo, consistent with your selected audience and privacy settings and applicable law.

This license ends when your content is deleted from our systems, except where continued retention or use is reasonably necessary for backups, legal compliance, safety, dispute resolution, content already shared with others, or other purposes permitted by law.

You are responsible for ensuring that you have the rights necessary to submit your content.

  1. Private Content and Communications

Certain mindo features are intended to be private or limited to selected participants, including private My Mind content and private or limited-audience communications.

We will operate these features according to their intended visibility and our Privacy Policy. However, no online service can guarantee absolute confidentiality or security. Recipients may also copy, save, screenshot, or disclose information you send them.

Do not use mindo to store or transmit information where disclosure could create unacceptable harm to you or another person.

  1. Acceptable Use

You agree not to:

Use mindo for unlawful, fraudulent, deceptive, or abusive purposes.

Threaten, harass, stalk, exploit, or seriously harm others.

Post or distribute content that violates our Community Guidelines.

Impersonate another person or misrepresent your affiliation with a person or organization in a deceptive manner.

Violate another person's intellectual property, privacy, publicity, or other legal rights.

Send spam, manipulate engagement, operate unauthorized automated accounts, scrape the service without permission, or interfere with mindo's systems.

Attempt to gain unauthorized access to accounts, systems, data, or networks.

Upload malware or other harmful code.

Use mindo to facilitate illegal transactions or activities.

Circumvent safety, access, rate, privacy, or technical restrictions.

We may investigate suspected violations and take appropriate action.

  1. Community Guidelines

Our Community Guidelines form part of the rules governing use of mindo. You agree to follow them.

We may remove or restrict content, limit features, suspend accounts, or terminate accounts when we reasonably determine that these Terms or the Community Guidelines have been violated or when action is reasonably necessary to protect users, DATAO, or the service.

  1. Interactions With Other Users

mindo can help people discover and communicate with one another, but DATAO does not control users' conduct and generally does not verify every statement, identity, credential, opportunity, or representation made by users.

Use your own judgment when interacting with others.

If you choose to meet another user in person, collaborate, exchange money, enter into an agreement, travel, or otherwise interact outside mindo, you are responsible for evaluating the situation and taking appropriate precautions.

mindo is not an emergency service. If you believe you or another person is in immediate danger, contact appropriate local emergency services.

  1. Intellectual Property

mindo, DATAO, and the associated software, design, branding, graphics, interfaces, and other materials provided by us are owned by DATAO or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by us, these Terms do not give you the right to use our trademarks, logos, branding, proprietary software, or other intellectual property.

If you believe content on mindo infringes your intellectual property rights, contact us.

  1. Third-Party Services

mindo may integrate with or link to third-party products, websites, authentication services, maps, content, or other services.

DATAO does not control and is not responsible for third-party services. Your use of them may be governed by separate terms and privacy policies.

  1. Account Suspension, Deletion, and Termination

You may stop using mindo at any time and may use available in-app controls to request deletion of your account.

We may suspend, restrict, or terminate your access if we reasonably believe you violated these Terms or our Community Guidelines, created risk or legal exposure, used the service abusively, or if suspension or termination is otherwise reasonably necessary to protect mindo, DATAO, users, or others.

Where appropriate, we may provide notice or an opportunity to appeal.

  1. Disclaimers

mindo is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

DATAO does not guarantee that mindo will always be available, uninterrupted, secure, error-free, or free from harmful components, or that content, recommendations, users, connections, opportunities, or information available through mindo will be accurate, reliable, safe, or suitable.

To the extent permitted by law, DATAO disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, DATAO and its officers, directors, employees, affiliates, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or opportunities arising from or relating to your use of mindo.

To the maximum extent permitted by law, DATAO's aggregate liability arising out of or relating to mindo or these Terms will not exceed the greater of the amount you paid DATAO for mindo during the twelve months before the event giving rise to the claim or US $100.

These limitations do not apply where prohibited by law.

  1. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DATAO and its officers, directors, employees, affiliates, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your content, your misuse of mindo, your violation of these Terms, or your violation of another person's rights.

  1. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any disputes that are not subject to a different legally required forum will be brought in courts of competent jurisdiction located in Georgia, unless applicable law gives you the right to bring a claim elsewhere.

  1. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date and provide additional notice when required by law or appropriate based on the nature of the changes.

Your continued use of mindo after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

  1. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to do so later.

You may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms as part of a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
